These Terms and Conditions set out the basis on which Rubbish Clearance Chiswick provides rubbish removal, waste collection and related clearance services. By making a booking, using our services, or allowing our team access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 We, us, our means Rubbish Clearance Chiswick, the provider of rubbish removal and waste collection services.
1.2 You, your, customer means the individual or business making the booking or otherwise using our services.
1.3 Services means any rubbish removal, waste collection, waste loading, clearance, transportation and related services we provide.
1.4 Waste means any items, materials or substances which you ask us to remove, excluding any hazardous or prohibited waste unless expressly agreed in writing.
1.5 Site means the address or location where our services are carried out.
2.1 We provide rubbish clearance and waste collection services for domestic and commercial customers within our designated service area. The precise services to be provided will be set out in our confirmation of your booking.
2.2 Our services typically include the loading of waste onto our vehicles, transportation, and disposal or recovery at an authorised facility in accordance with applicable waste regulations.
2.3 We reserve the right to refuse to remove any waste which, in our reasonable opinion, is hazardous, unsafe, illegal to transport, or not as described at the time of booking.
2.4 We may make reasonable adjustments to the services described where necessary to protect health and safety, comply with legal obligations, or respond to site conditions, provided that such changes do not materially reduce the overall nature of the service.
3.1 Bookings may be made by telephone, email or through any other communication method we make available. All bookings are subject to acceptance and availability.
3.2 When you make an enquiry, we may ask for information including, but not limited to, the type and approximate volume or weight of waste, the location of the waste, access details, parking arrangements, and preferred date and time.
3.3 Any estimate or quote provided before viewing the waste is based on the information you supply. You are responsible for ensuring that the information you provide is accurate and complete.
3.4 We will confirm your booking by email, text or other written communication where possible. The contract between you and us is formed when we issue a booking confirmation or when we begin providing the services, whichever occurs first.
3.5 We reserve the right to refuse a booking or cancel a confirmed booking for reasonable cause, including but not limited to safety concerns, suspected unlawful activity, or inability to access the site.
4.1 Unless stated otherwise, any price we give you before attending the site is an estimate based on the information you provide. The final price may change following a physical assessment of the waste and access conditions.
4.2 Our charges are usually based on factors including volume of waste, weight, type of materials, time on site, and any additional services requested such as dismantling, packing or extra labour.
4.3 If the actual waste or conditions differ significantly from those described at the time of booking, we will inform you of any change in price before commencing or continuing work. If you do not accept the revised price, we may cancel the service and you may be liable for a call-out or minimum charge.
4.4 All prices are stated in pounds sterling. Where applicable, prices will include any VAT or similar sales tax, which will be clearly indicated.
5.1 Unless otherwise agreed in advance, payment is due in full on completion of the services on the day of collection.
5.2 We accept payment by cash, bank transfer, card payment or any other method notified to you at the time of booking or service.
5.3 For business customers with agreed credit terms, an invoice will be issued following completion of the services. Payment must be made within the period stated on the invoice.
5.4 If you fail to make any payment on the due date, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in pursuing the debt.
5.5 Title to the waste passes to us only once payment is received in full, subject to compliance with waste regulations. We reserve the right to suspend or cancel services if payments are outstanding.
6.1 You may cancel or amend your booking by contacting us directly. We ask that you give as much notice as reasonably possible so that we can reallocate resources.
6.2 If you cancel a booking with at least 24 hours notice before the scheduled arrival time, no cancellation fee will normally be charged.
6.3 If you cancel with less than 24 hours notice, or if we attend the site and are unable to carry out the services for reasons within your control (including lack of access, incorrect address, or waste not being available), we may apply a reasonable cancellation or call-out fee to cover our costs.
6.4 We may cancel or rearrange bookings where circumstances beyond our control arise, including but not limited to severe weather, traffic incidents, vehicle breakdown, staff illness or legal restrictions. In such cases we will inform you as soon as reasonably practicable and offer an alternative appointment.
6.5 We are not liable for any losses you may incur due to cancellation or rescheduling, save as expressly provided in these Terms and Conditions.
7.1 You are responsible for providing safe, reasonable and lawful access to the site and the waste to be collected.
7.2 You must ensure that any necessary permissions are in place for our vehicles to park near the site, including any required permits or authorisations. Any parking fees or penalties arising as a result of the services may be charged to you if due to incomplete or incorrect information provided by you.
7.3 You must inform us in advance of any access restrictions, security procedures, stairs, narrow entry points, or other factors that may reasonably affect our ability to carry out the services.
7.4 If our team reasonably considers that access is unsafe or impracticable, we may refuse to proceed or may propose an alternative solution, potentially with an additional charge.
8.1 Our rubbish clearance services cover a broad range of household, garden and commercial waste, including general rubbish, furniture, appliances and non-hazardous materials.
8.2 Certain materials are hazardous or require specialist handling and cannot be removed under a standard booking. These may include asbestos, clinical or medical waste, chemicals, solvents, pressurised containers, fuel, oils, explosives, and other specialist or dangerous substances.
8.3 If you present hazardous or prohibited items for collection without prior notification, we may refuse to handle them and may charge for any time spent on site, or for any additional costs incurred to make the situation safe.
8.4 You confirm that all waste you present for collection is yours to dispose of or that you have full authorisation from the legal owner or occupier to arrange its removal.
9.1 We operate in accordance with relevant UK waste management legislation and regulations, and we take all reasonable steps to ensure that waste collected is transported and disposed of lawfully.
9.2 Your provision of waste to us under these Terms and Conditions constitutes a transfer of controlled waste. Where required, we will complete appropriate documentation for the transfer and keep records for the legally required period.
9.3 We will normally dispose of or recover waste at licensed waste transfer stations, recycling centres or other authorised facilities. We may separate recyclable materials where reasonably practicable to reduce the environmental impact of disposal.
9.4 We are not responsible for any legal consequences arising from false or misleading information you give us about the origin, nature or composition of the waste.
10.1 You agree to cooperate with us in all matters relating to the services, including providing access, instructions, information and any consents or permissions required.
10.2 You must ensure that the site is reasonably clear and safe for our team to work and that any known risks, such as structural defects, sharp objects or hazardous materials, are disclosed in advance.
10.3 You must remove or secure any personal items that you do not wish to be taken as waste. Our team may treat items within the waste area as rubbish unless clearly identified otherwise.
10.4 You agree not to instruct our staff to act in a way that would breach health and safety rules, waste regulations or these Terms and Conditions.
11.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
11.2 Subject to the above, we shall not be liable for any indirect, consequential or economic losses, including loss of profit, business interruption, or loss of data, arising out of or in connection with the services.
11.3 Our total liability to you in respect of any loss or damage arising from the services, whether in contract, tort, breach of statutory duty or otherwise, shall be limited to the total price paid or payable for the specific services giving rise to the claim.
11.4 You must notify us in writing of any damage to property or other issues you believe were caused by us as soon as reasonably possible and in any event within 7 days of completion of the services. We may not consider claims raised outside this period without good reason.
11.5 We are not liable for damage or loss where our team has followed your specific instructions against our advice, or where damage results from pre-existing defects, structural weaknesses or conditions beyond our control.
12.1 We maintain insurance cover appropriate to the nature of our operations in the rubbish clearance and waste collection sector.
12.2 The existence of insurance does not extend or increase our liability beyond the limitations set out in these Terms and Conditions.
13.1 We collect and process personal information such as your name, contact details and service address for the purpose of managing bookings, providing services, processing payments and meeting legal obligations.
13.2 We will handle your personal data in accordance with applicable UK data protection laws and only retain it for as long as necessary for the purposes for which it was collected or as required by law.
13.3 You are responsible for ensuring that any personal data you provide to us is accurate and up to date.
14.1 If you are unhappy with any aspect of our services, please contact us as soon as possible so we can attempt to resolve the matter promptly.
14.2 We will investigate complaints in a fair and reasonable manner and may ask for additional information, photographs or access to the site to assess any concerns.
15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, applicable laws or regulatory requirements.
15.2 The version of the Terms and Conditions that applies to your booking is the version in force on the date we confirm your booking, unless a change is required by law or regulatory authority.
16.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.
